 Since 2018, the New Jersey Department of Labor and Workforce Development has, through regulation and   practice, treated owner-operators as employees of the motor carriers that hire them, contrary to state statutory   law.  Effectively, NJDOL has overturned its governing legislation and in its audits of motor carriers, imposed   significant back state employment taxes even though motor carriers are supposed to be statutorily exempt from   them.  Learn the legal basis of NJDOL’s actions, the existing challenges to them, and whether changes can be expected considering the recent gubernatorial election.
